Privacy Policy AYA of Sweden, Sleeping World AB
This policy applies specifically to those who purchase our Sleep Tracker or subscribe to our service that includes a Sleep Tracker.
1. BACKGROUND
Sleeping World AB is a company that helps people sleep better. We do this by selling products and services, but also by offering a digital subscription service that gives you access to a Sleep Tracker and an app that collects data about how you sleep and uses that data to provide tips and recommendations for what you can do to sleep better.
In this policy, we will refer to this as (the "Service"). The Service is provided by Sleeping World AB, corporate identity number 559085-8477, ("Sleeping World" or "We"). This Privacy Policy describes Sleeping World's processing of your personal data and is intended to describe how we collect, use and delete personal data. By following this Privacy Policy, we ensure that your personal data is treated with respect and in accordance with applicable data protection laws when you use the Service.
For your peace of mind, Sleeping World has taken technical and organizational security measures to ensure that your personal data is protected from unauthorized access, use, modification and deletion.
2. DATA CONTROLLER
Sleeping World is the data controller for the processing of your personal data carried out by Sleeping World. Information on how to contact us can be found in section 12.
3. WHEN DOES SLEEPING WORLD COLLECT PERSONAL DATA?
3.1.
Sleeping World collects personal data about you when:
- You create an account with Sleeping World and use the Service,
- You order information, an additional service, or product from Sleeping World,
- You register as a subscriber to an email or newsletter,
- You make error reports or for any other reason contact Sleeping World's customer service,
- You link the Service to your Facebook account or other similar third party services that are independently responsible for personal data,
- You respond to a survey, including but not limited to customer satisfaction surveys or market research or respond to communications from Sleeping World, or
- It is otherwise necessary to administer the relationship between you and Sleeping World.
3.2.
Sleeping World also collects information through its own or third-party cookies and similar tracking technologies that may log your activities and choices when you use the Service or visit our website.
4. WHAT PERSONAL DATA DOES SLEEPING WORLD COLLECT?
4.1.
When you create an account with Sleeping World or are in contact with Sleeping World's customer service, Sleeping World collects personal data about you. Examples of personal data that Sleeping World typically collects are your name and/or username, email and/or phone number and payment information. For those who are members and use the Service to measure your sleep, we also collect this data every night you use the Sleep Tracker:
- How you breathe
- Your heart rate
- How much you move
- The temperature in your bedroom
- Humidity in the air
Based on this data, we analyze your sleep and also keep historical data on your sleep. In order to make an accurate analysis, we also collect data on your gender, age, weight, height and other data you enter when you register. All the data we collect is for the purpose of providing the best possible advice on your sleep.
When you use the Service or other Sleeping World services or products and when you visit the Sleeping World website, Sleeping World may collect usage, viewing and technical data, including your IP address.
4.2.
If you choose to connect the Service to Facebook or other similar third party services responsible for personal data, Sleeping World may collect such information, which you thereby authorize Facebook or such similar service to share with Sleeping World.
4.3.
Sleeping World may also collect and process information that you provide in public forums on the Sleeping World website or make available to Sleeping World when you use the Sleeping World website, Sleeping World's pages on third party platforms, such as social media, or when you link your profile on a third party site or platform with your personal account in the Service.
4.4.
Sleeping World may also collect and process information related to your chosen payment method. The personal data collected by Sleeping World for this purpose serves as a basis for confirming your authorization to use the Service and for identifying your payment method. Because Sleeping World works with third party payment service providers who operate independently on systems separate from Sleeping World, no complete payment information, such as a full credit card number, will be collected or processed by Sleeping World.
5. HOW LONG IS THE DATA STORED?
Sleeping World will retain your personal data for as long as necessary for the purposes of the processing. This means that personal data collected and processed for marketing purposes is stored for as long as you have an account with Sleeping World and is deleted twelve (12) months after your subscription has ended unless you have given Sleeping World your voluntary consent for the continued processing of such data. In order to control the use of gift cards and free trials and prevent abuse, the basic information you provided at the time of registration (name, username, e-mail address, telephone number, payment details) will be retained for a period of twenty-four (24) months after the end of your subscription, gift card or trial. Sleeping World will retain data for longer periods if required by law or if it is necessary to ensure that Sleeping World's legal interests are met, for example in ongoing litigation.
6. WHY DOES SLEEPING WORLD PROCESS DATA ABOUT ME?
6.1.
Sleeping World processes your personal data for the main purpose of providing you with the best possible help to improve your sleep. The majority of the data collected is used for this purpose but some data is needed to enable us to provide, administer, develop and customize the Service and its features, to administer the customer relationship with you and to comply with security and regulatory requirements. Your personal data may also be used for market and customer analysis, market research, statistics, business follow-up and business and method development. This may include, for example, the processing of personal data for the purpose of creating customer groups on third-party platforms.
6.2.
Sleeping World further processes your personal data to provide a better and more personalized experience of the Service. Sleeping World may also analyze and combine information about you that Sleeping World has access to through the Service from your online visits or other sources (such as Facebook or other similar social media providers) for the purposes specified in this section.
6.3.
In addition, Sleeping World processes your personal data in order to prevent, detect and investigate potential prohibited or illegal activities, including fraud, and to enforce our Terms (for example, to determine whether you are eligible for a free trial or other offers and promotions that may be offered).
7. WHAT IS THE LEGAL BASIS FOR PROCESSING?
7.1.
The majority of the personal data that Sleeping World processes about you is processed in order for Sleeping World to fulfill our part of the service agreement (Terms of Use) with you, i.e. for Sleeping World to provide and administer the Service and its features. This is the case when Sleeping World processes e.g. e-mail address, telephone number and information from payment service providers.
7.2.
Finally, certain data is processed on the basis of your consent. This is the case when data that Sleeping World obtains via your Facebook is processed and for marketing the goods and services of Sleeping World's partners.
7.3.
To the extent that processing of personal data is based on consent, it is voluntary for you to give such consent and you may withdraw your consent at any time, in whole or in part. If you choose to withdraw your consent and Sleeping World's processing is such that requires consent, in such case your most recent consent will apply and processing will then take place in accordance with it.
8. DATA SECURITY AND PRIVACY
The security, integrity and confidentiality of your personal data are very important to us. We have put in place technical, administrative and physical security measures designed to protect your personal data from unauthorized disclosure, use and modification. From time to time, we evaluate these measures to determine the need to take additional measures or update existing ones. Please note that, although we have taken all reasonable steps, there are no security measures that are completely secure. We therefore ask you to inform us immediately of any suspicious activities you may detect on the Service.
9. TO WHOM DOES SLEEPING WORLD DISCLOSE THE DATA?
9.1.
Sleeping World may disclose your personal data to companies within Sleeping World's group, partners and other third parties for the purpose of fulfilling the agreement with you or for the fulfillment of agreements with Sleeping World's suppliers and partners.
9.2.
Sleeping World may also disclose personal data to companies that process personal data on behalf of Sleeping World, such as IT suppliers, customer service companies and group companies. If personal data is disclosed to companies that process personal data on behalf of Sleeping World, Sleeping World enters into an assistance agreement with this party to ensure that a high level of protection for your personal data is maintained.
9.3.
Personal data may also be disclosed if it is necessary to comply with applicable law or requirements from authorities, to defend Sleeping World's legal interests or to detect, prevent or draw attention to fraud and other security-related or technical problems.
9.4.
Your personal data may be transferred to or stored in a country outside the EU/EEA. If we transfer or store your data outside the EU/EEA, we will ensure that such transfer is made in accordance with this policy and in accordance with applicable laws, for example, by entering into data transfer agreements that include the standardized model data transfer clauses adopted by the European Commission and available on the European Commission's website.
10. LINKS TO EXTERNAL WEBSITES
Information provided by Sleeping World may contain links to websites operated or owned by someone other than Sleeping World. Sleeping World is not responsible for the processing of personal data that takes place on these websites. Sleeping World therefore encourages you to read the information relating to the processing of personal data available on each website.
11. CHANGES TO THE PRIVACY POLICY
This privacy policy may be adjusted from time to time. If Sleeping World makes material changes to the Privacy Policy, Sleeping World will inform you by email or through the Service before the changes take effect. The Privacy Policy will also be published on the Sleeping World website. If changes require your consent, Sleeping World will ask for a new consent from you.
12. RIGHT TO REQUEST INFORMATION AND RECTIFICATION ETC. PRIVACY POLICY
12.1.
You have the right to receive free information about, among other things, what personal data Sleeping World processes about you and for what purpose (so-called register extract). Such a request for a register extract must be in writing and signed by you.
12.2.
You have the right to have inaccurate, misleading or incomplete data corrected, de-identified or deleted. You also have the right to request Sleeping World to restrict the processing of your personal data and to object to the processing of your personal data. You also have the right to exercise your right to data portability, which means that you have the right to receive your data in a structured, commonly used and machine-readable format.
12.3.
Please note that some of the above rights only apply in specific situations, such as the right to data portability which only applies where the processing is based on a contract or consent and the processing is automated. 12.4.
If you do not want Sleeping World to use your personal data for direct marketing purposes, you can notify Sleeping World in writing. In each newsletter you will also be informed of your possibility to object to further newsletters.
12.5.
You also have the right to lodge a complaint with the supervisory authority at any time if you believe that your personal data is being processed in violation of applicable data protection legislation.
